Court satisfies the complaint of the UOC community in Ugrinov

In Ugrinov the community of the UOC has been trying to defend its rights through the court for the fourth year now

The Supreme Court of Ukraine overturned the decisions of the courts, according to which the claim of the UOC community of Exaltation of the Holy Cross to Ugrinov’s village council was declined by the latter’s decision to grant the land plot under the priest’s house to the community of the Kyiv Patriarchate. It is reported by the correspondent of the UOJ.

In February 2018, the Cassation Administrative Court, as part of the Supreme Court of Ukraine, determined a simplified procedure for the cassation appeal from the Holy Cross Exaltation community of the UOC of Ugrinov village, Gorokhov district, Volyn region. The complaint challenged the decision of Gorokhov district court of Volyn region on February 27, 2015 and the decision of Lvov administrative court of appeal of June 23, 2015. At that time the community of the canonical Church was denied its claim to Ugrinov village council, which had handed over a land plot to the community of the UOC-KP, where the priest's house is located.

In the cassation instance, after a three-year pause, it was decided to cancel both judicial verdicts and send the case for reconsideration.

Violation of the village council, according to the suit of the UOC community, is that the above land plot was already allocated by the decision of the executive committee of Ugrinov Village Council No. 2 of March 12, 1991, to the church community, i.e. to the believers of the Ukrainian Orthodox Church for the construction of a single-family residential house.

As for the community of the UOC-KP, which on November 17, 2014 was given a "green light" as for the documents registration for the house where the family of the UOC priest is registered, it emerged in the register of legal entities only 6 days before the session of the village council, on November 11. At the same time, the Holy Cross Exaltation church of the UOC in Ugrinov was seized by schismatics as early as September.
